Terms of Service

1. Acceptance

By purchasing or using any product from SCS (Sierra Chart Studies), you agree to be bound by these Terms of Service. If you do not agree, do not use our products. The version that applies is the one published on this page on the day of your purchase or renewal; the date above tells you which one that is.

SCS is the trade name of Charles Ferry, Sole trader (entrepreneur individuel) established in France. The full identity of the seller is on the Legal Notice page.

2. Products and license

SCS sells two kinds of products: Sierra Chart custom studies, delivered by authorizing your Sierra Chart account so the study appears in Sierra Chart on the next restart, and Windows desktop applications (Trading Journal, Market Pulse, Copier Manager), delivered as a signed installer and unlocked by a license key. Both are licensed for your personal use, on the accounts and machines the product allows. The license is non-transferable. Redistribution, resale, sharing of study access or license keys, and reverse engineering of the studies or applications are prohibited.

A desktop application may be activated on a limited number of machines at a time, shown in your dashboard. During the beta, the Copier Manager is included with the Trade Copier subscription and shares its term: it stops accepting new accounts when the subscription ends, as described in section 4.

3. Payments

All payments are processed securely by Stripe. Prices are shown in US dollars or in euros depending on your location, and the currency you see at checkout is the currency you are charged in. Custom studies are sold as a one-time purchase. Trade Manager, Trading Journal, Market Pulse, Trade Copier (with the Copier Manager) and the bundle are billed as monthly or yearly subscriptions, cancellable at any time from your dashboard; a cancelled subscription runs to the end of the period already paid and is not renewed. Prices are the amounts charged; where VAT applies, it is included and shown on your invoice.

Free trials take no card and no payment details: a trial is never billed and does not turn into a subscription. It ends on its own at the date shown in your dashboard, and you can end it early from your dashboard at any time. Ending a trial early is final.

4. Software that places or manages orders

The Trade Copier, the Copier Manager and the Trade Manager send, modify, cancel or flatten orders on your trading accounts according to the settings you choose. You remain the trader: you configure them, you supervise them, and every order they place is yours. Before using them on a live or funded account, test your setup on a simulated account and read the documentation of the product, including its known limitations.

• SCS does not guarantee that an order is copied, filled, placed at a given price or within a given time. Latency, slippage, rejected orders, data feed or connection outages, broker or platform limits, machine sleep or restarts, and your own configuration can all prevent or alter a copy.
• Safety features (loss guards, kill switch, auto-flatten, timeouts) are tools that reduce risk; they do not remove it. A guard that cannot read your account's profit and loss says so and does not protect you.
• The rules of your broker and of your proprietary trading firm apply to you, not to the software. Some firms restrict or forbid copiers, automated or group trading, or opposite positions across accounts. It is your responsibility to check them, in writing, before you copy into such an account. SCS software adds no random delay and hides nothing from your broker or firm.
• When your access ends while a position is open, new entries are refused after a short grace period; exits, stops and flatten keep working. Keep your positions supervised in Sierra Chart regardless.

5. Right of withdrawal (EU and UK consumers)

If you are a consumer in the European Union or the United Kingdom, you normally have 14 days to withdraw from a distance purchase without giving a reason. How this applies depends on what you bought.

• One-time purchases (custom studies, lifetime licenses) are digital content delivered immediately: by purchasing, you expressly request that delivery begins at once (your Sierra Chart account is authorized, or your license key is issued, within minutes) and you acknowledge that you thereby lose your right of withdrawal. Our voluntary refund policy for these purchases is described on the refund page.
• Subscriptions are services that begin at once at your request. You may still withdraw within 14 days of your first payment; you then pay only for the days elapsed, and the rest of that first period is refunded. After these 14 days, the cancellation rules of section 3 apply.

To exercise the right of withdrawal, write to support@scstudies.com within the 14 days, naming your order and stating your decision. No form is required.

6. Disclaimer and limitation of liability

SCS products are tools to assist with technical analysis, risk calculation and order management. They do not constitute financial advice, and nothing on this site is a recommendation to trade. Trading involves a significant risk of loss. The products are provided as they are; SCS does not warrant that they are free of defects or fit for a particular purpose beyond what their documentation states.

To the extent permitted by law, SCS is not liable for trading losses, lost profits or indirect damages incurred while using its products, and its total liability for any claim is limited to the amounts you paid to SCS in the twelve months preceding the claim. Nothing in these terms limits a liability that cannot be limited under the law that applies to you, including for consumers the statutory guarantees of conformity.

7. Changes to these terms

We may update these terms. The date at the top changes with the text, and a change that reduces your rights applies to a subscription only from its next renewal. Continued use after a renewal means acceptance of the terms in force at that date.

8. Governing law and disputes

These terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. Before any court action, write to support@scstudies.com: most issues are settled within a few days.

Consumers residing in the European Union may also use consumer mediation, which is free for the consumer. The contact details of our mediator are available on request from support@scstudies.com. Failing an amicable settlement, the competent courts are those designated by the applicable law.
